GENERAL TERMS AND CONDITIONS FOR ENROLLMENT IN SPANISH COURSES FOR INTERNATIONAL STUDENTS AT THE LANGUAGE CENTER OF THE UNIVERSITY OF VALLADOLID<\/strong><\/span><\/h4>\n

 <\/p>\n

  1. \n

    ENROLLMENT CONDITIONS<\/strong><\/span><\/h4>\n<\/li>\n<\/ol>\n

     <\/p>\n

    1.1<\/span>. Acceptance of the terms<\/strong><\/p>\n

    Enrollment in any Spanish course for international students offered by the Language and Training Center of the University of Valladolid, managed by the Fundaci\u00f3n Universidad de Valladolid M.P., constitutes the student\u2019s express and unconditional acceptance of these General Terms and Conditions and the applicable Data Protection Policy.<\/p>\n

    1.2<\/span>. Formalization of enrollment<\/strong><\/p>\n

    The educational services contract is formalized between the Fundaci\u00f3n Universidad de Valladolid M.P. and the student or, where applicable, the university, agency, or collaborating entity managing the enrollment.<\/p>\n

    The contract becomes effective once the enrollment process has been completed and the corresponding enrollment number has been issued.<\/p>\n

    1.3.<\/span> Admission requirements<\/strong><\/p>\n

    Enrollment is subject to compliance with the academic, administrative, and legal requirements established for each course, as well as the submission of all required documentation within the applicable deadlines.<\/p>\n

    Only people aged eighteen (18) or over may enroll.<\/p>\n

    As an exception, students aged sixteen (16) or seventeen (17) may be admitted if they are accompanied or supervised by a legal guardian who expressly assumes responsibility for them throughout their stay.<\/p>\n

    All students must complete an online placement test before the course begins. The results will be used to assign students to the most appropriate level and group.<\/p>\n

    1.4.<\/span> Enrollment fee<\/strong><\/p>\n

    The applicable fees are those set out in the current official fee schedule published by the Language and Training Center of the University of Valladolid.<\/p>\n

    Unless expressly stated otherwise, the enrollment fee includes:<\/p>\n

    \u2212 Administrative processing and reservation of a place.<\/p>\n

    \u2212 Online placement test.<\/p>\n

    \u2212 Registration and enrollment in the contracted course.<\/p>\n

    \u2212 Accommodation arrangements, where applicable.<\/p>\n

    \u2212 A university student card providing access to certain university facilities.<\/p>\n

    \u2212 Assessment tests and the corresponding certificate of attendance and\/or achievement.<\/p>\n

    1.5.<\/span> Payment terms<\/strong><\/p>\n

    The payment terms applicable to each training format will be specified during the enrollment process.<\/p>\n

    The student may either pay only the administrative and place-reservation costs initially or pay the full enrollment fee in a single payment.<\/p>\n

    As a general rule, the full course fee must be paid at least twenty-one (21) calendar days before the scheduled start date.<\/p>\n

    If any amount remains unpaid, the Center may suspend access to classes, academic activities, assessments, certificates, and other related services until the outstanding amount has been paid in full.<\/p>\n

    1.6.<\/span> Groups and academic organization<\/strong><\/p>\n

    Places are limited.<\/p>\n

    As a general rule, groups will consist of a minimum of six (6) and a maximum of fourteen (14) students. However, the Center\u2019s Management may establish different group sizes depending on the academic characteristics of each program.<\/p>\n

    The Center\u2019s Management may reorganize groups, schedules, classrooms, teaching staff, and complementary academic activities when required for organizational, academic, or educational reasons.<\/p>\n

    1.7.<\/span> Organizational changes<\/strong><\/p>\n

    The Center may make reasonable changes to academic calendars, schedules, teaching staff, classrooms, or complementary activities for academic, organizational, technical, or force majeure reasons.<\/p>\n

    Dates falling on national, regional, or local public holidays will be considered non-teaching days. Classes scheduled for those dates will not be rescheduled.<\/p>\n

    1.8.<\/span> Course, level, and group changes<\/strong><\/p>\n

    As a general rule, course changes are not permitted once enrollment has been formalized.<\/p>\n

    However, the Center\u2019s Management may authorize a course change provided that: (i) the enrollment fee has been paid in full; (ii) the change is academically appropriate; (iii) there are available places in the new course; (iv) the change is requested no later than the start of the following academic year; and (v) any difference in fees has been paid.<\/p>\n

    Any other change will be subject to the refund conditions established in Section 3 of these General Terms and Conditions<\/p>\n

    Students may request a change of level or group within the same course. Such changes require authorization from the Academic Office and will only be approved when there are justified reasons, available places, and the change is academically appropriate.<\/p>\n

    1.9.<\/span> Certificates<\/strong><\/p>\n

    At the end of the course, students will receive the corresponding certificate of attendance and\/or achievement, where applicable.<\/p>\n

    To be eligible to take the assessment tests, students must attend at least eighty percent (80%) of the scheduled teaching hours.<\/p>\n

    For Erasmus Spanish Courses, the minimum attendance requirement is seventy-five percent (75%) of the scheduled teaching hours.<\/p>\n

    1.10.<\/span> Health insurance<\/strong><\/p>\n

    All students must have health insurance that provides coverage in Spain for the entire duration of their stay.<\/p>\n

    Students from European Union countries must hold a European Health Insurance Card or an equivalent document providing access to health care during their stay.<\/p>\n

    Students may also purchase the optional health insurance offered by the Language and Training Center, subject to the applicable terms and fees.<\/p>\n

      CANCELLATION AND WITHDRAWAL FROM ENROLLMENT<\/strong>\u00a0<\/strong><\/span><\/h5>\n<\/li>\n<\/ol>\n

       <\/p>\n

      2.1.<\/span> Definition and effects<\/strong><\/p>\n

      Cancellation or withdrawal from enrollment means that the student loses their status as a student on the contracted course and that the academic rights associated with the enrollment come to an end.<\/p>\n

      Withdrawal may be requested by the student or decided by the Center.<\/p>\n

      2.2.<\/span> Withdrawal requested by the student<\/strong><\/p>\n

      Voluntary withdrawal is subject to the refund conditions set out in section 3 of these General Terms and Conditions.<\/p>\n

      2.3.<\/span> Withdrawal decided by the Center<\/strong><\/p>\n

      The Center may cancel an enrollment in any of the following circumstances:<\/p>\n

      \u2212 Full or partial non-payment of the amounts due.<\/p>\n

      \u2212 Failure to meet the admission requirements.<\/p>\n

      \u2212 Failure to submit the required documentation.<\/p>\n

      \u2212 Serious or repeated breach of the Center\u2019s rules on conduct, discipline, coexistence, or internal procedures.<\/p>\n

       <\/p>\n

      1. \n
        REFUND POLICY AND RIGHT OF WITHDRAWAL<\/strong><\/span><\/h5>\n<\/li>\n<\/ol>\n

         <\/p>\n

        The cancellation and refund conditions set out below apply without prejudice to the statutory right of withdrawal described in section 3.6, where applicable.<\/p>\n

        3.1.<\/span> General refund procedure<\/strong><\/p>\n

        Refund requests must be submitted in writing by email to espanol@centroidiomas.uva.es.<\/p>\n

        The request must include the student\u2019s identification details, the course concerned, the reason for the request, and any relevant supporting documentation, where applicable.<\/p>\n

        All refund requests are subject to review and express approval by the Center\u2019s Management.<\/p>\n

        Before reaching a decision, the Center may offer reasonable academic alternatives, such as a change of date, group, or session, provided that places are available.<\/p>\n

        3.2.<\/span> General conditions applicable to all enrollments<\/strong><\/p>\n

        3.2.1.<\/span> Administrative and place-reservation costs<\/strong><\/p>\n

        Administrative and place-reservation costs cover the administrative and academic work required to process the enrollment, open and manage the student\u2019s file, conduct placement tests, reserve a place, and organize the course and teaching resources.<\/p>\n

        These costs are calculated as the applicable percentage of the contracted course fee.<\/p>\n

        They are non-refundable when the student voluntarily cancels the enrollment.<\/p>\n

        They will only be refunded if the cancellation or the inability to provide the course is exclusively attributable to the Center.<\/p>\n

        Visa refusals, visa delays, failure to obtain a visa, delays in obtaining administrative permits, and other circumstances beyond the Center\u2019s control do not entitle the student to a refund of these costs.<\/p>\n

        3.2.2<\/span>. Accommodation and insurance<\/strong><\/p>\n

        One hundred percent (100%) of the amount paid for accommodation and insurance will be refunded if the cancellation is communicated at least fourteen (14) calendar days before the scheduled start date.<\/p>\n

        If the cancellation is made less than fourteen (14) days before the accommodation start date, an amount equivalent to seven (7) nights\u2019 accommodation will be retained.<\/p>\n

        In the case of insurance, a full refund will only be issued if the coverage has not yet started and no costs have been incurred.<\/p>\n

        Once the accommodation has started or the insurance coverage has been activated, no refund will be issued, except in exceptional circumstances approved by the Center\u2019s Management.<\/p>\n

        The student or participant is responsible for any damage caused by improper or negligent use of the facilities or property of host families, residences, or apartments.<\/p>\n

        Failure to use contracted services for reasons attributable to the student or participant does not entitle them to a price reduction or refund.<\/p>\n

        3.3.<\/span> Refund conditions for INDIVIDUAL ENROLLMENTS<\/span><\/strong><\/p>\n

        3.3.1<\/span>. Cancellations before the course begins<\/strong><\/p>\n

        \u2192\u00a0 If the student communicates the cancellation at least twenty-one (21) calendar days before the scheduled course start date, the course fee will be refunded. However, administrative and enrolment reservation fees, equivalent to fifteen percent (15%) of the enrollment fee, will not be refunded<\/strong> in cases of voluntary cancellation under this section, without prejudice to the legal right of withdrawal and other cases where a refund is legally required.<\/p>\n

        \u2192\u00a0 If the student communicates the cancellation less than twenty-one (21) calendar days before the scheduled course start date, fifty percent (50%) of the total enrollment fee<\/strong> will be refunded.<\/p>\n

        3.3.2.<\/span> Cancellations after the course has begun<\/strong><\/p>\n

        \u2192 Once the course has begun, the student is not entitled to a refund.<\/p>\n

        However, requests based on the exceptional circumstances described in section 3.5 may be considered.<\/p>\n

        In all cases, administrative and place-reservation costs, equivalent to fifteen percent (15%) of the enrollment fee, are non-refundable.<\/p>\n

         <\/p>\n

        3.4.<\/span> Conditions applicable to GROUP ENROLLMENTS<\/span> managed by universities, institutions, or collaborating entities<\/strong><\/p>\n

        3.4.1<\/span>. Scope of application<\/strong><\/p>\n

        These conditions apply to students belonging to groups whose enrollment is managed through universities, educational institutions, public or private organizations, intermediary agencies, or other collaborating entities.<\/p>\n

        For financial and administrative purposes, the collaborating entity will be considered the contracting party for the places it manages.<\/p>\n

        Participation in a group organized by a collaborating entity does not change the cancellation or refund conditions applicable to each participant.<\/p>\n

        All refunds, retentions, discounts, penalties, financial adjustments, and settlements arising from the withdrawal or cancellation of participants will be managed exclusively with the collaborating entity.<\/p>\n

        3.4.2.<\/span> Cancellations before the course begins<\/strong><\/p>\n

        \u2192\u00a0 The full tuition fee will be refunded if the contracting institution provides notice of cancellation at least 14 calendar days before the scheduled course start date. However, 5% of the total tuition fee will be retained to cover administrative processing costs.<\/p>\n

        \u2192\u00a0 80% of the total tuition fee will be refunded when cancellation is notified less than 14 calendar days before the scheduled course start date. In this case, 20% of the total tuition fee will be withheld to cover administrative processing costs.<\/p>\n

        \u00a0<\/span>3.4.3<\/span>. Cancellations after the course has begun<\/strong><\/p>\n

        Once the course has begun, the student is not entitled to a refund.<\/p>\n

        However, requests based on the exceptional circumstances described in section 3.5 may be considered.<\/p>\n

        If a refund is approved, the corresponding financial settlement will be made exclusively with the collaborating entity that managed the enrollment. In all cases, a retention of at least five percent (5%) of the total enrollment fee will be applied to cover administrative processing costs.<\/p>\n

        3.4.4.<\/span> Effects on the group<\/strong><\/p>\n

        The withdrawal or cancellation of one or more participants will not affect the continuity of the program or change the financial, academic, or organizational conditions applicable to the rest of the group.<\/p>\n

        A reduction in the number of participants will not give rise to compensation or financial adjustments.<\/p>\n

        Each cancellation will nevertheless lead to a review of the program\u2019s overall budget. If the reduction in the number of students affects previously applied discounts or financial arrangements, those discounts or arrangements may be modified accordingly.<\/p>\n

        3.4.5.<\/span> Visas and administrative authorizations<\/strong><\/p>\n

        The refusal, delay, revocation, or failure to obtain a visa, residence permit, or other administrative authorization required to participate in the course will be considered a circumstance beyond the Center\u2019s control.<\/p>\n

        These circumstances will therefore not give rise to a refund, except where expressly provided for in these General Terms and Conditions.<\/p>\n

        Any financial consequences arising from these situations will be managed exclusively with the collaborating entity responsible for the contract.<\/p>\n

        3.5.<\/span> Assessment of exceptional circumstances<\/strong><\/p>\n

        For the purposes of applying the refund policy, the following situations, among others, may be assessed on a case-by-case basis:<\/p>\n

        \u2212 Hospitalization of the student.<\/p>\n

        \u2212 Surgery undergone by the student.<\/p>\n

        \u2212 Serious and documented illness affecting the student.<\/p>\n

        \u2212 Death of a family member up to the second degree of consanguinity or affinity.<\/p>\n

        \u2212 Properly documented force majeure.<\/p>\n

        \u2212 Other exceptional circumstances supported by appropriate documentation.<\/p>\n

        The submission of supporting documents does not automatically create a right to a refund.<\/p>\n

        All cases will be assessed exclusively by the Center\u2019s Management.<\/p>\n

        3.6.<\/span> Right of Withdrawal<\/strong><\/p>\n

        In accordance with Royal Legislative Decree 1\/2007 of 16 November, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the student may exercise the statutory right of withdrawal within fourteen (14) calendar days of the formalization of the enrollment.<\/p>\n

        The request must be submitted in writing to espanol@centroidiomas.uva.es.<\/p>\n

        If the right of withdrawal is validly exercised within the statutory period, all amounts paid will be refunded.<\/p>\n

        By accepting these terms, the student expressly agrees that the educational services may begin before the withdrawal period has ended.<\/p>\n

        Accordingly, once the course has begun, the right of withdrawal will no longer apply.<\/p>\n

         <\/p>\n

          DATA PROTECTION<\/strong><\/span><\/h5>\n<\/li>\n<\/ol>\n

           <\/p>\n

          During the enrollment process and the management of the training activity, the Language and Training Center of the University of Valladolid, managed by the Fundaci\u00f3n Universidad de Valladolid M.P., must process the student\u2019s personal data.<\/p>\n

          In accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Organic Law 3\/2018 of 5 December, the following information is provided:<\/p>\n

          Data controller: Fundaci\u00f3n Universidad de Valladolid M.P.<\/p>\n

          Data Protection Officer: dpo@fundacion.uva.es<\/p>\n

          Purposes of processing:<\/p>\n

          \u2212 Managing enrollment in the requested course or training activity.<\/p>\n

          \u2212 Notifying students of their grades through the website of the Language and Training Center of the University of Valladolid.<\/p>\n

          \u2212 Sending electronic communications about other activities and training courses organized by the Foundation.<\/p>\n

          Legal basis: The legal basis for processing is Article 6(1)(a) and (b) of the GDPR: the existence of a contractual or pre-contractual relationship for enrollment and management of the training activity, and the data subject\u2019s consent to receive electronic communications from the Foundation.<\/p>\n

          Data retention: Personal data will be retained for as long as necessary to fulfill the purposes for which it was collected and to determine any potential liabilities arising from the processing.<\/p>\n

          Data subject rights: After verifying their identity, students may exercise their rights of access, rectification, erasure, restriction of processing, and objection by contacting dpo@fundacion.uva.es.<\/p>\n

          Students may also lodge a complaint with the Spanish Data Protection Agency at any time.<\/p>\n

          Additional information: Data protection information<\/a><\/p>\n

            FORCE MAJEURE<\/strong><\/span><\/h5>\n<\/li>\n<\/ol>\n

             <\/p>\n

            The Center will not be liable for any failure or delay in fulfilling its obligations when the failure or delay results from unforeseeable or unavoidable events beyond its control.<\/p>\n

            In such cases, the Center may modify calendars, schedules, teaching methods, or delivery systems in order to ensure, as far as reasonably possible, the continuity of the training activity.<\/p>\n

            1. \n
              APPLICABLE LAW AND JURISDICTION<\/strong><\/span><\/h5>\n<\/li>\n<\/ol>\n

               <\/p>\n

              These General Terms and Conditions are governed by and interpreted in accordance with Spanish law and, where applicable, in particular by Law 7\/1998 of 13 April on General Contracting Conditions, Royal Legislative Decree 1\/2007 of 16 November, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, and Law 34\/2002 of 11 July on Information Society Services and Electronic Commerce, without prejudice to any other applicable legislation.<\/p>\n

              Any dispute arising from the interpretation, application, or performance of these General Terms and Conditions will be submitted to the competent courts in accordance with the applicable legislation.<\/p>\n

              Where the contracting party is not a consumer or user and an agreement on jurisdiction is legally permitted, the parties expressly submit to the courts of Valladolid.<\/p>\n
